WASHINGTON TOWNSHIP BOARD OF ZONING APPEALS MINUTES

April 9, 2007

The Washington Township Board of Zoning Appeals met in regular session on April 9, 2007 in the Meeting Room of Washington Township Government Center. Members of the Board present were Mr. Horine, Mrs. Mulligan, Mr. Ciambrone, Mrs. Fischer and Mr. Gross (as alternate).

Call to order at 7:00 p.m.

Mr. Horine explained the hearing format and voting procedure.

The Oath was administered by Mr. Horine.

MOTION – Mrs. Mulligan moved the minutes of March 26, 2007 be approved with modifications.

Motion seconded by Mr. Gross.

VOTE - Mr. Horine, yes; Mrs. Mulligan, yes; Mr. Ciambrone, yes; Mrs. Fischer, yes; Mr. Gross, yes.

Case A-1496 – Saddlecreek Associates, Ltd., Clyo Road

Request a variance in the sign regulations to permit one (1) additional free standing identification sign for property located in a Planned Development Residential (PD-R) zoning district.

Jack Kuntz , Zoning Inspector, presented the case.

Applicant represented by Gary Menchhoffer, Great Traditions. Mr. Menchhoffer addressed the Board with reasons for the variance requested.

Motion – Mr. Ciambrone moved in Case A-1496 to approve applicant’s request for a variance in the sign regulations to permit one (1) additional free standing identification sign located in a Planned Development Residential (PD-R) zoning district, subject to: 1) both signs must be twenty-seven (27) square feet as shown versus the thirty-two (32) square feet single sign permitted by the ordinance.

Motion seconded by Mrs. Mulligan.

VOTE - Mr. Horine, yes; Mrs. Mulligan, yes; Mr. Ciambrone, yes; Mrs. Fischer, yes; Mr. Gross, yes.

Case A-1496 approved with modification.

Case A-1497 – Tom Smith/Caribou Coffee, 5847 Far Hills Avenue

Request is for a variance in the sign regulations to permit a wall sign on the north elevation of the building for property located in a Business (B-2) zoning district.

Jack Kuntz , Zoning Inspector, presented the case.

Applicant represented by Jeff Johnson of Caribou Coffee, Minneapolis, Minnesota.

Mr. Gross – Questioned if there was a sign on the south elevation or above the drive-through window.

Mr. Johnson – No.

Mr. Horine – How big is the Caribou Coffee chain and are they of similar design?

Mr. Johnson – Indicated there are 500 locations and they all vary in size.

Mr. Horine – Asked if the signs are a standard package for Caribou Coffee?

Mr. Johnson – Yes.

Motion – Mrs. Mulligan moved in Case A-1497 to approve applicant’s request for a variance in the sign regulations to permit a wall sign on the north elevation of the building on property located in a Business (B-2) zoning district.

Case A-1498 – Frank & Billie Sanders, 9139 Sugarbrook Court

Request is for a variance to decrease the side yard set back from the required thirteen and one half feet (13.5’) to ten feet (10’) to allow for an addition to a single family home located in a Planned Development Residential (PD-R) zoning district.

Jack Kuntz , Zoning Inspector, presented the case.

Applicant represented by Frank Sanders, 9139 Sugarbrook Court. Mr. Sanders explained to the Board his reasons for the variance requested. He has spoken with his neighbors and found they have no objections to the variance. His intention is to match all the building materials to the existing home.

Motion – Mrs. Fischer moved in Case A-1498 to approve applicant’s request for a variance to decrease the side yard set back from the required thirteen and one half feet (13.5’) to ten feet (10’) to allow for an addition to a single family home located in a Planned Development Residential (PD-R) zoning district.

Motion seconded by Mrs. Mulligan.

VOTE - Mr. Horine, yes; Mrs. Mulligan, yes; Mr. Ciambrone, yes; Mrs. Fischer, yes; Mr. Gross, yes.

Case A-1498 approved.

Case A-1499 – Daniel and Trixie Brewer, 10300 Black Birch Drive

Request is for a variance to decrease the rear yard set back from the required fifty feet (50’) to thirty feet (30’) to allow for an addition to a single family home located in a Planned Development Residential (PD-R) zoning district.

Jack Kuntz , Zoning Inspector, presented the case.

Applicant represented by Daniel Brewer, 10300 Black Birch Drive. Mr. Brewer explained his request.

Mr. Horine – Asked what the project actually is.

Mr. Brewer – Indicated it will be a screened in area such as an indoor/outdoor area.

Mr. Gross – Asked if the addition will be have heating and air conditioning.

Mr. Brewer – No.

Mr. Horine – What is the square footage of the home?

Mrs. Mulligan – Stated the Recorder’s Office indicates it has 3,940 square feet.

Motion – Mrs. Fischer moved in Case A-1499 to approve applicant’s request for a variance to decrease the rear yard set back from the required fifty feet (50’) to thirty feet (30’) to allow for an addition to a single family home located in a Planned Development Residential (PD-R) zoning district.

Motion seconded by Mr. Gross.

VOTE - Mr. Horine, yes; Mrs. Mulligan, yes; Mr. Ciambrone, yes; Mrs. Fischer, yes; Mr. Gross, yes.

Case A-1499 approved.

In other business:

There was discussion among the Board members about the election of a new Board of Zoning Appeals Chairperson and Vice Chairperson.

MOTION – Mr. Horine moved to appoint Richard Ciambrone as the Board of Zoning Appeals Chairperson.

Motion seconded by Mrs. Fischer.

VOTE - Mr. Horine, yes; Mrs. Mulligan, yes; Mr. Ciambrone, yes; Mrs. Fischer, yes; Mr. Gross, yes.

MOTION – Mrs. Fischer moved to appoint Dan Horine as the Board of Zoning Appeals Vice Chairperson.

Motion seconded by Mr. Ciambrone.

VOTE - Mr. Horine, yes; Mrs. Mulligan, yes; Mr. Ciambrone, yes; Mrs. Fischer, yes; Mr. Gross, yes.
