WASHINGTON TOWNSHIP BOARD OF ZONING APPEALS MINUTES

November 26, 2007

The Washington Township Board of Zoning Appeals met in regular session on November 26, 2007 in the Meeting Room of the Washington Township Government Center. Members of the Board present were Mr. Horine, Mrs. Mulligan, Mrs. Fischer, Mrs. Fish and Mr. Schwartz (as alternate).

Call to order at 7:00 p.m.

Mr. Horine explained the hearing format and voting procedure.

The Oath was administered by Mr. Horine.

MOTION – Mrs. Fischer moved the minutes of November 12, 2007 be approved as submitted.

Motion seconded by Mrs. Mulligan.

VOTE - Mr. Horine, yes; Mrs. Mulligan, yes; Mrs. Fischer, yes; Mrs. Fish, yes; Mr. Schwartz, yes.

Case A-1519 – Marc E. Cary, 1416 Quaker Way

Request is for a variance to increase the maximum height of fencing in the front yard from the required four feet (4’) to six feet (6’) located in a Residential 4 (R-4) zoning district.

Andy Ehrhart, Zoning & GIS Manager, presented the case.

Applicant represented by Marc Cary, 1416 Quaker Way. Mr. Cary indicated they wanted to tie into the existing fence without loosing too much of the yard. He presented a sample of the type of fencing he is proposing. Mr. Cary stated the type of fence would not impede anyone’s view along Clyo Road.

Mrs. Mulligan – Questioned if this is applicant’s first home?

Mr. Cary – Stated it is their first home they have had built.

Mrs. Fischer – Asked applicant if they are willing to change the height to a five foot (5’) fence?

Mr. Cary – Yes.

Mrs. Fish – Questioned if there is a Homeowners’ Association?

Mr. Cary – No.

Motion - Mrs. Fischer moved in Case A-1519 to approve applicant’s request for a variance to increase the maximum height of fencing in the front yard from the required four feet (4’) to five feet (5’) located in a Residential 4 (R-4) zoning district.

Case A-1519 approved with modification.

Case A-1520 – Muha Construction, 855 Congress Park Drive

Request is for a variance in the sign requirements to allow for a stucco/EIFS sign base to be used in lieu of the required brick or stone base located in an Industrial (I-1) zoning district.

Andy Ehrhart, Zoning & GIS Manager, presented the case.

Applicant represented by Monte Williams of Kap Signs, 1608 Kuntz Road, Dayton. Mr. Williams indicated that Dave Muha, applicant, would like to match the building and feels it would look nicer.

Mr. Horine – Questioned the longevity of the product proposed.

Mr. Wi lliams – Explained to the Board the application procedure of the product.

Mrs. Fish – Stated the process is more like stucco.

Motion - Mrs. Mulligan moved in Case A-1520 to approve applicant’s request for a variance in the sign requirements to allow for a stucco sign base to be used in lieu of the required brick or stone base located in an Industrial (I-1) zoning district.

Case A-1520 approved with modification.

Case A-1521 – Carol Muth, 7021 Garrison Court

Request is for variances to: 1) reduce the required side yard setback from fifteen feet (15’) to ten feet (10’), and 2) reduce the required rear yard setback from fifty feet (50’) to forty-four feet (44’) to allow for an addition located in a Residential 4 (R-4) zoning district.

Andy Ehrhart, Zoning & GIS Manager, presented the case.

Applicant represented by Alex Luque, 1045 Centerville Station Road, Centerville. Mr. Luque indicated that this is a work in progress. There are some structural considerations as well as roof lines to consider in trying to meet the needs of his client. Mr. Luque presented the elevations to the Board.

Mrs. Fischer – Asked Mr. Luque to show the existing house and where the addition would be located.

Mr. Luque – Reviewed the plans with the Board.

Motion - Mr. Schwartz moved in Case A-1521 to approve applicant’s request for a variance to reduce the required side yard setback from fifteen feet (15’) to ten feet (10’) to allow for an addition located in a Residential 4 (R-4) zoning district.

Case A-1521 approved in reference to the side yard setback.

Motion - Mr. Schwartz moved in Case A-1521 to approve applicant’s request for a variance to reduce the required rear yard setback from fifty feet (50’) to forty-four feet (44’) to allow for an addition located in a Residential 4 (R-4) zoning district.

Motion seconded by Mrs. Fischer.

VOTE - Mr. Horine, yes; Mrs. Mulligan, yes; Mrs. Fischer, yes; Mrs. Fish, yes; Mr. Schwartz, yes.

Case A-1521 approved in reference to the rear yard setback.
