WASHINGTON TOWNSHIP BOARD OF ZONING APPEALS MINUTES

August 14, 2006

The Washington Township Board of Zoning Appeals met in regular session on August 14, 2006 in the Meeting Room of Washington Township Government Center. Members of the Board present were Mr. Khouri, Mr. Horine, Mrs. Mulligan, Mrs. Fischer and Mr. Ciambrone.

Call to order at 7:00 p.m.

Mr. Khouri explained the hearing format and voting procedure.

The oath was administered by Mr. Khouri.

MOTION – Mrs. Fischer moved the minutes of June 26, 2006 be approved as submitted.

Motion seconded by Mrs. Mulligan.

VOTE - Mr. Khouri, yes; Mr. Horine, yes; Mrs. Mulligan, yes; Mr. Ciambrone, yes; Mrs. Fischer, yes.

MOTION – Mr. Horine moved the minutes of July 24, 2006 be approved as submitted.

Motion seconded by Mrs. Mulligan.

VOTE - Mr. Khouri, yes; Mr. Horine, yes; Mrs. Mulligan, yes; Mr. Ciambrone, yes; Mrs. Fischer, yes.

Case A-1470 – KG Land Co., LLC, Dayton-Lebanon Pike

Request is for a variance in the front yard set back from the required sixty feet (60’) to approximately fifty-five feet (55’) to allow for a primary structure to be located in a Business (B-2) zoning district.

Mr. Khouri – Excused himself from hearing the case due to a conflict of interest.

Jack Kuntz , Zoning Inspector, presented the case.

Applicant represented by Alex Kolodesh, 2500 Kettering Tower, Dayton, Ohio. Mr. Kolodesh presented a general overview of the project.

Mr. Horine and Mr. Kolodesh discussed the traffic flow problem.

Mr. Horine – Questioned if staff has commented on this project.

Mr. Kuntz – It is township policy that staff cannot comment regarding recommendations.

Mrs. Fischer – Asked about the existing tenants in other buildings.

The Board and Mr. Kuntz discussed the curb cut issue and staff’s discussion about it.

Motion – Mrs. Fischer moved in Case A-1470 to approve applicant’s request for a variance in the front yard set back from the required sixty feet (60’) to approximately fifty-five feet (55’) to allow for a primary structure to be located in a Business (B-2) zoning district, subject to: 1) the north curb cut onto the auxiliary road be approved.

Motion seconded by Mrs. Mulligan.

VOTE - Mr. Khouri, abstain; Mr. Horine, no; Mrs. Mulligan, yes; Mr. Ciambrone, yes; Mrs. Fischer, yes.

Mr. Horine – Thinks it is a bad placement for the project due to the traffic flow and parking issues.

Case A-1470 approved with modification.

Case A-1471 – Renee L. Blankenship, 700 Selma Road

Request is for a variance to decrease the side yard set back from the required twenty feet (20’) to eleven feet (11’) for an addition to a single family residence located in a Single Family Residential (R-2) zoning district.

Jack Kuntz , Zoning Inspector, presented the case.

Applicant represented by Harold Wuebben, father of Ms. Blankenship, 460 W. Rahn Road. Mr. Wuebben indicated he would answer any questions the Board has for him.

Mr. Khouri and Mr. Wuebben discussed the screening for the neighbors.

Ms. Blankenship – Addressed the lighting issue and indicated she has discussed the plans with the neighbors.

Mr. Khouri – Asked about the existing variance.

Ms. Blankenship – Indicated they would drop whichever variance does not work.

Motion – Mrs. Mulligan moved in Case A-1471 to approve applicant’s request for a variance to decrease the side yard set back from the required twenty feet (20’) to eleven feet (11’) for an addition to a single family residence locate din a Single Family Residential (R-2) zoning district, subject to: 1) screening be placed between the addition and the neighbors property; and 2) whichever variance that is not used becomes null and void.

Motion seconded by Mrs. Fischer.

VOTE - Mr. Khouri, yes; Mr. Horine, yes; Mrs. Mulligan, yes; Mr. Ciambrone, yes; Mrs. Fischer, yes.

Case A-1471 approved with modifications.
