MINUTES
August 28, 2006
The Washington Township Board of Zoning Appeals met in regular session on August 28, 2006 in the Meeting Room of Washington Township Government Center. Members of the Board present were Mr. Horine, Mrs. Mulligan, and Mr. Ciambrone. Mr. Khouri and Mrs. Fischer were excused.
Call to order at 7:00 p.m.
Mr. Horine explained the hearing format and voting procedure.
The oath was administered by Mr. Horine.
MOTION – Mr. Ciambrone moved the minutes of August 14, 2006 be approved with modifications.
Motion seconded by Mrs. Mulligan.
VOTE - Mr. Horine, yes; Mrs. Mulligan, yes; Mr. Ciambrone, yes.
Case A-1472 – Caribou Coffee, 5847 Far Hills Avenue
Request is for a variance in the required conditions of a Business (B-2) zoning district to allow for outdoor seating.
Jack Kuntz , Zoning Inspector, presented the case.
Applicant represented by Stacy Blase, 2605 Ida Avenue, Columbus, Ohio. Ms. Blase indicated that the variance requested is for Caribou seating.
Mr. Horine – Questioned the maintenance of the outdoor seating.
Ms. Blase – Indicated the patio will be power washed three (3) times a year and the seating will be stored during the winter months.

Motion - Mr. Ciambrone moved in Case A-1472 to approve applicant’s request for a variance in the required conditions of a Business (B-2) zoning district to allow for outdoor seating.
Motion seconded by Mrs. Mulligan.
VOTE - Mr. Horine, yes; Mrs. Mulligan, yes; Mr. Ciambrone, yes.
Case A-1472 approved.
Case A-1473 – Regent Systems, 7590 Paragon Road
Request is for a variance to reduce the freestanding sign setback from the required twenty feet (20’) to fifteen feet (15’) to allow for the construction of a new freestanding identification sign located in an Industrial (I-1) zoning district.
Jack Kuntz , Zoning Inspector, presented the case.
Applicant represented by Don Allison, Allison Construction, 7590 Paragon Road. Mr. Allison presented the case and submitted evidence of other signs between 15’ and 10’ from the right of way.

Case A-1474 – Dennis F. Moore, Sr., 8385 Garnet Drive
Request is for a variance to permit an entry gate, on a lot with one hundred sixty feet (160’) of lot frontage for a single family residence located in an Agricultural (A) zoning district.
Jack Kuntz , Zoning Inspector, presented the case.
Applicant represented by Dennis Moore and Linda Moore, property owners, 8385 Garnet Drive. Mr. Moore submitted pictures of what the gate will look like. He stated a gate is necessary for privacy and safety.
Mrs. Mulligan – Asked if he built the house.
Mr. Moore – Yes. He bulldozed the old house.
Mr. Ciambrone – Asked if the fence will be forty feet (40’) from the right of way?
Mr. Moore – Yes.
Citizens voicing concerns, question and comments included:
Joyce Becker, 8437 Garnet Drive – Lives in the next house south of Mr. Moore. Stated there is a problem with the gully/ditch and the maintenance of it.
Mr. Moore – Stated there will not be a problem with the ditch.
Mr. Horine – Asked applicant if the fence will be placed over the ditch?
Mr. Moore – Yes.
Mrs. Mulligan – Asked Ms. Becker if there are any problems with kids.
Ms. Becker – One person.

Mr. Ciambrone – Asked applicant if he was in agreement with the conditions from the Fire Department.
Mrs. Moore – Yes.
Mr. Horine – Feels that the entry gate will improve the property.

Motion - Mr. Ciambrone moved in Case A-1474 to approve applicant’s request for a variance to permit an entry gate, on a lot with one hundred sixty feet (160’) of lot frontage for a single family residence located in an Agricultural (A) zoning district, subject to: 1) meeting the requirements and recommendations set forth by the Washington Township Fire Department dated August 17, 2006, including but not limited to the 45’ setback from the right of way; and 2) this approval being made for this particular variance only and not to be used as a precedent for future properties. Mr. Ciambrone noted that the narrowness of the lot presented a practical difficulty for this particular piece of property.
Motion seconded by Mrs. Mulligan.
VOTE - Mr. Horine, yes; Mrs. Mulligan, yes; Mr. Ciambrone, yes.
Case A-1474 approved with modifications.
Case A-1475 – David R. Nelson, 73 W. Whipp Road
Request is for a variance to decrease the rear yard set back from the required fifty feet (50’) to forty-eight feet (48’) for an addition to a single family residence located in a Single Family Residential (R-4) zoning district.
Jack Kuntz , Zoning Inspector, presented the case.
Applicant represented by Dave Spiter, All Seasons Remodeling, and Dave Nelson, homeowner, 73 W. Whipp Road. Mr. Spiter addressed the Board and inquired them the building materials will match exactly to the existing house.
Mr. Horine – Will the building materials be wood siding?
Mr. Spiter – It will be vinyl siding, which is the same material on the existing house.
Mr. Nelson – Gave the history of the house and his reasons for the need of an addition. Mr. Nelson also presented two (2) petitions from the neighbors agreeing to the project and having no objections to the variance requested.
