The Washington Township Board of Trustees met in Regular Session on January 23, 2006, at 7:30 p.m. at the Washington Township Government Center, 8200 McEwen Road. President Snyder led the Pledge of Allegiance.

Mrs. Young welcomed the Boy Scouts attending the Trustee meeting and asked them to introduce themselves. She then introduced each member of the Trustees and asked Mr. Huff to introduce the staff members in attendance.
FIRE LIEUTENANT PROMOTION
Chief Ken Parks and Human Resources Technician Dawn Barnett have been working the last few months on a promotional process for a full-time lieutenant in the Fire Department. The process included an assessment board, a written test and an oral interview. Firefighter/Paramedic Scott Kujawa did extremely well during the entire process and staff is recommending that he be promoted to full-time lieutenant.
It was moved by Mr. Snyder, seconded by Mr. Blair, that the Board promotes Firefighter/Paramedic Scott Kujawa, 7870 Old Dobbin Place, Centerville, Ohio, to full-time lieutenant, at Union Contract Lieutenant Grade 7, effective February 1, 2006.

ZONING CASE Z-671 DIVIDED RIDGE ASSOCIATES
An application has been received for approximately 24 acres of land located on the east side of the Washington Trace subdivision, on a proposed stub street. The property is currently zoned Agricultural. The proposal is for Planned Development Residential Two-Stage to contain 42 single-family lots. The Zoning Commission reviewed this application at their December 20, 2005, meeting and recommended approval.
Senior Planner Greg DeLong made a staff presentation. His slide presentation included a zoning and vicinity map, a land use master plan, an aerial photograph, and site photos. He also presented a plan showing the proposed area of rezoning and a preliminary layout. To the left of the project is the approved Washington Trace project and to the right is the approved
Weatherstone project. Both projects would be connected to this development. The setbacks they are proposing are the same as those of Washington Trace. The density they are proposing is 1.74 units per acre. The Montgomery County Planning Commission and the Zoning Commission both recommended approval for rezoning. The developer of the Weatherstone project, George Reinke, submitted a letter in support of the proposed development and is asking the Trustees to approve the density of 1.75 units per acre.
Greg Smith represented Oberer Land Development and Divided Ridge Associates. He indicated that he was seeking Phase I PUD approval on Washington Trace Annex. Mr. Smith asked the Trustees to approve the density of 1.75 units per acre. Washington Trace (including the multi-family) currently has a density of 1.86 units per acre and Weatherstone has approval for 1.74. The property to the south, Soroya Farms, is in Warren County and has a density of 2.2 units per acre. They are proposing connecting streets. The street winds around the project in order to discourage speeding traffic. The main entrance is on Social Row Road, coming through Washington Trace. They plan to mirror the Washington Trace D lots with 90’ minimum lot width; 30’ front yard minimums; 15’ total side yard, 5’ minimum side yard and 30’ minimum rear yard setbacks. These setbacks will allow them to vary a little more at the sides, to put in more projecting front porches or side entry garages, and will result in a higher-priced product mix since they can put bigger houses on the lots. He also asked that the Trustees do the same as they did for Washington Trace and allow them to maintain constant setbacks throughout the development. This would allow for a continuous flow along the lots and would match Washington Trace. They intend to submit a landscape plan later, after they have incorporated some of the comments made by the landscape architect.
Mrs. Young asked if the Zoning Commission approved the density and setbacks. Mr. Blair pointed out that the Zoning Commission did approve 42 single-family lots, which would make the density 1.75. He, too, preferred that the Zoning Commission approve the setbacks before being considered by the Trustees.
Mrs. Young closed the public hearing for the zoning case.

LIQUOR PERMIT
Captain Osterfeld is in receipt of a request for a new liquor permit for a restaurant doing business as Chow’s Asian Bistro, to be located at 1061 Miamisburg Centerville Road. She has reviewed the request and sees no reason to object. No action taken.

Contracts
Each year Washington Township contracts with the Montgomery County Sanitary Engineering Department to repair Township streets that are damaged by water main breaks or to perform routine sanitary sewer repairs. This contract allows the Township to be reimbursed for sanitary manholes or water valves that need to be adjusted during the street resurfacing program. Staff has recently received a new contract for 2006, which would allow a total reimbursement of up to $73,000.
It was moved by Mr. Blair, seconded by Mr. Snyder, that the Board authorizes entering into agreement with the Board of County Commissioners, Montgomery County, Ohio, for the repair of Township roadways that have been damaged by water main breaks or to make sanitary sewer repairs at a maximum cost of $65,000 for water main breaks and valve box adjustments and $8,000 for manhole adjustments.

Road Certification
Each year Washington Township is asked to certify the number of roadway centerline miles to the County Engineer. In 2005, the Township added just under one mile of roadway, bringing the Township’s total to 133.8 miles.

ADDENDUM
Reappointment of Attorney
It is a requirement of the Ohio Revised Code for the Board of Trustees to reappoint attorneys annually; therefore, staff recommended that Surdyk, Dowd & Turner Co., L.P.A. be re-appointed to provide legal services for the Township and that Robert J. Surdyk be re-appointed as Law Director. The re-appointments were adopted by Home Rule Resolution.

WHEREAS, Washington Township has elected to become a limited self-government form of township government under Chapter 504 of the Ohio Revised Code; and,
WHEREAS, R.C. §504.15 requires a limited self-government form of township government to appoint a Township Law Director; and enables a township to employ additional legal counsel; and,
NOW, THEREFORE, BE IT RESOLVED by the Board of Trustees of Washington Township, Montgomery County, Ohio that Surdyk, Dowd & Turner Co., L.P.A. be employed to provide legal services to the Township and that Robert J. Surdyk of that firm be reappointed as Law Director of Washington Township.
BE IT FURTHER RESOLVED that Surdyk, Dowd & Turner Co., L.P.A. be paid the rate of $135.00 to $160.00 per hour for the services of an attorney and $75.00 per hour for the services of all paralegals. In addition, Surdyk, Dowd & Turner Co., L.P.A. shall be reimbursed for all out-of-pocket expenses incurred upon the submission of appropriate documentation.

Mr. Huff reminded the Trustees that there would be a Coalition of Large Ohio Urban Townships (CLOUT) lunch on February 2 nd during the Winter Conference of the Ohio Township Association in Columbus, Ohio.
