July 19, 2005

The Washington Township Zoning Commission met in regular session on July 19, 2005 in the Meeting Room of Washington Township Government Center. Members of the Commission present were Mr. Drain, Mrs. Zobrist, and Mr. Anderson. Mr. Rogers and Mrs. Winwood were excused.

Call to order at 7:00 p.m.

The Pledge of Allegiance was recited.

All in attendance were duly sworn in.

MOTION – Mrs. Zobrist moved the minutes of June 29, 2005 be approved as submitted.

Motion seconded by Mr. Anderson.

VOTE - Mr. Drain, yes; Mrs. Zobrist, yes; Mr. Anderson, yes.

Mr. Drain explained that only three commission members were present and gave the applicants the option to table their case until additional members are present.

CASE Z-512J – Bossi Investments, Ltd., 1800-1860 Lyons Road

Request is for second stage and final plan approval for Buildings B-1 and B-2 for approximately 2.06 acres of property zoned Planned Development Office 2 (PD-O2). Building B-1 contains 2,852 square feet and is for medical use; Building B-2 contains 3,567 square feet and is for professional offices. This property is located on the south side of Lyons Road.

Tom Toberen , Deputy Administrator, presented the case.

Applicant represented by Ron Bossi, Developer, 1820 Lyons Road.

Mr. Drain – Asked about the parking calculations.

Mr. Toberen – Indicated that based on the information they submitted, applicant meets the parking requirements.

Mr. Drain – Asked about the additional landscaping that was requested in the Z-512I zoning case.

Mr. Bossi – The plantings that have been added are only six (6) months old and he feels that they will grow.

Mr. Drain – Will the buildings have the same roof pitch, building materials, etc.?

Mr. Bossi – Yes.

Mr. Anderson – Asked what types of trees would be planted?

Mr. Bossi – They will plant the same type as the existing ones on the site.

Citizens voicing concerns, questions and comments included:

Phil Gallagher, 6716 Innsbruck Drive – Stated that he will be the owner of Building B-1. He plans on having a well landscaped building and feels that the township will be happy with the results.

Public hearing closed.

Commission remarks, concerns and comments included:

Mrs. Zobrist – Feels that the project is fine.

Mr. Anderson – Does not have a problem with the proposed project.

Mr. Drain – Would like the developer to work with the Washington Township VIP Consultant on the landscaping for the project.

MOTION – Mrs. Zobrist moved in Case Z-512J to approve applicant’s request for second stage and final plan approval for Buildings B-1 and B-2 for approximately 2.06 acres on property zoned Planned Development Office 2 (PD-O2) subject to: 1) the sign to be located 20’ from the Lyons Road right of way; 2) all staff comments; and 3) the developer to meet with the Washington Township VIP Consultant.

Motion seconded by Mr. Anderson.

VOTE - Mr. Drain, yes; Mrs. Zobrist, yes; Mr. Anderson, yes.

Case Z-512J approved with modifications.

CASES Z-669 & Z-669A – Winning Colors Investments, LLC (Woodburn Creek)

The request in Case Z-669 is for a change in zoning from the current Agricultural (A) to Planned Development Residential (PD-R) two stage for the construction of a development containing 32 single family lots on approximately 20.03 acres.

The request for Case Z-669A is for second and final stage approval for the construction of a development containing 32 single family lots on approximately 20.03 acres in a Planned Development Residential (PD-R) zoning district.

This property is located on the south side of Meadow Woods Lane.

Tom Toberen , Deputy Administrator, presented the case.

Applicant represented by John Koverman, attorney for applicant, 1251 Cedar Creek Circle; George Reinke, The Reinke Group, 959 Congress Park Drive; and Bob Rhoads, Developer, 4300 Willow Creek Circle.

Mr. Drain – Are there any plans on doing anything with the open space to the east?

Mr. Reinke – They plan on keeping it natural.

Mr. Drain – Asked about the staff comment requesting walking paths to the common area.

Mr. Reinke – They would like to keep the common area as passive and would not like to encourage people to go back there.

Mr. Anderson – Questioned the size of the detention basin and the fact that it is located in a wooded area.

Mr. Reinke – The final size of the basin will be determined in the final engineering and they will be required to clear the existing trees in that area.

Mr. Anderson – Will there be one developer or will the lots be sold to individuals?

Mr. Reinke – They may sell to individual builders but they would be required to follow the covenants and restrictions.

Mr. Anderson – Questioned the covenant stating that vinyl siding is not allowed. Feels this is too open-ended and it could possibly allow aluminum siding.

Mr. Koverman – They would be willing to add a restriction for no aluminum siding but would not want restrictions put on the developer as far as building materials.

Mr. Rhoads – Would like to have the flexibility with architectural styles and materials.

Mr. Drain – Questioned the location of any landscaping. The only location would be near the detention basin. Does not really see the need for a landscape plan.

Citizens voicing concerns, questions and comments included: None.

Commission remarks, concerns and comments included:

Mr. Drain – Feels it is an appropriate development for the area. He also does not have a problem with the setbacks as presented.

Mrs. Zobrist – Does not have a problem with the project.

Mr. Anderson – Does not have a problem but feels some of the staff comments are not appropriate based on the discussion tonight.

MOTION - Mr. Drain moved in Case Z-669 to approve applicant’s request in Case Z-669 is for a change in zoning from the current Agricultural (A) to Planned Development Residential (PD-R) two stage for the construction of a development containing 32 single family lots on approximately 20.03 acres subject to: 1) staff comments with the exception of the comments of Andy Ehrhart, GIS & Zoning Manager; and 2) approval of the side yard setbacks of a minimum of 10’ with a minimum 27’ between structures.

Motion seconded by Mr. Anderson.

VOTE - Mr. Drain, yes; Mrs. Zobrist, yes; Mr. Anderson, yes.

Case Z-669 approved with modifications.

MOTION - Mr. Drain moved in Case Z-669A to approve applicant’s request for second and final stage approval for the construction of a development containing 32 single family lots on approximately 20.03 acres in a Planned Development Residential (PD-R) zoning district, subject to: 1) staff comments with the exception of the comments of Andy Ehrhart, GIS & Zoning Manager; 2) approval of the side yard setbacks of a minimum of 10’ with a minimum 27’ between structures; and 3) based on the plans submitted.
