WASHINGTON TOWNSHIP ZONING COMMISSIONMINUTES

January 17, 2006

The Washington Township Zoning Commission met in regular session on January 17, 2006 in the Meeting Room of Washington Township Government Center. Members of the Commission present were Mr. Rogers, Mr. Drain, Mrs. Winwood, Mrs. Zobrist, and Mr. Anderson.

Call to order at 7:00 p.m.

The Pledge of Allegiance was recited.

MOTION – Mrs. Zobrist moved the minutes of December 20, 2005 be approved with modifications.

Motion seconded by Mrs. Winwood.

VOTE - Mr. Rogers, abstain; Mr. Drain, yes; Mrs. Winwood, yes; Mrs. Zobrist, yes; Mr. Anderson, yes.

All in attendance were duly sworn in.

CASE Z-512K – Bossi Investments, Ltd., 1800-1860 Lyons Road

Request is for a change in zoning from the current Planned Development Office 2 (PD-O2) to Planned Development Office 2 (PD-O2) second stage and final plan and for the approval of an approximately 580 square foot addition that will connect buildings located at 1840 Lyons Road and 1860 Lyons Road.

Mr. Drain – Mentioned that Mrs. Winwood and her family are friends with Mr. Bossi; however, he does not feel that will affect her ability to make an impartial decision on the case.

Greg DeLong , Senior Planner, presented the case.

Mr. Drain – Is there confirmation that the exterior materials will match the existing materials?

Mr. DeLong – Yes.

Applicant represented by Ron Bossi, 860C E. Franklin Street, Centerville, Ohio.

Mr. Drain – Questioned applicant if there are plans to enhance the landscaping in the islands?

Mr. Bossi – Yes. Mr. Bossi stated he met with the VIP Consultant and they plan on adding the landscaping in the spring.

Mrs. Zobrist – Asked if Dr. Gallagher is agreeable to the proposed change?

Mr. Bossi – Yes.

Citizens voicing concerns, questions and comments included: None.

Commission remarks, concerns and comments included:

Mr. Anderson – Stated he has no objection. He did recommend the motion should include staff comments and make reference to the landscaping.

MOTION – Mr. Anderson moved in Case Z-512K to approve applicant’s request for a change in zoning from the current Planned Development Office 2 (PD-O2) to Planned Development Office 2 (PD-O2) second stage and final plan and for the approval of an approximately 580 square foot addition that will connect buildings located at 1840 Lyons Road and 1860 Lyons Road subject to: 1) staff comments; 2) landscaping in the islands as discussed; and 3) drawings updated prior to being presented to the Trustees.

Motion seconded by Mr. Rogers.

VOTE - Mr. Rogers, yes; Mr. Drain, yes; Mrs. Winwood, yes; Mrs. Zobrist, yes; Mr. Anderson, yes.

Case Z-512K approved with modifications.

CASE Z-588E – Divided Ridge Associates, Ltd. ( Washington Trace)

Request is for a Planned Development Residential (PD-R) second stage and final plan approval to change a previously approved site plan as part of the Washington Trace Planned Development in order for the development to meet County Engineer requirements. The proposed modifications include lot and road reconfigurations. This property is approximately 283.79 acres located along the east and west sides of Sheehan Road, south of W. Social Row Road.

Greg DeLong , Senior Planner, presented the case.

Staff presentation broke down the proposed modifications into eleven (11) areas.

Mr. Anderson – Asked if the change in #3 decreases the open space?

Mr. DeLong – It decreases the open space minimally; however, they have picked up additional open space in other areas.

Applicant represented by Greg Smith, Oberer Companies, 2800 E. River Road, Dayton, Ohio.

Mrs. Zobrist – Asked about the area of weeds between Sheehan Road and the landscape areas in front of Section 1.

Mr. Smith – They will do a better job of maintaining that area until Sheehan Road is widened.

Mr. Drain – Asked if they will still have the statues?

Mr. Smith – Yes, they will maintain the amenity package.

Citizens voicing concerns, questions and comments included: None.

Commission remarks, concerns and comments included:

Mr. Rogers – Feels that the project is way too dense and is a poor design; however, he did mention that the Commission has been voted down in the past.

Mrs. Winwood - Agrees with Mr. Rogers and feels that in 10 years when you drive through the development it will feel claustrophobic.

Mrs. Zobrist – Feels that the changes are improvements.

Mr. Drain – Also feels that the changes are improvements to the project.

MOTION – Mrs. Zobrist moved in Case Z-588E to approve applicant’s request for a Planned Development Residential (PD-R) second stage and final plan approval to change a previously approved site plan as part of the Washington Trace Planned Development subject to: 1) staff comments; and 2) meeting with the VIP Consultant to work out details of the landscaping.

Motion seconded by Mr. Anderson.

VOTE - Mr. Rogers, no; Mr. Drain, yes; Mrs. Winwood, abstain; Mrs. Zobrist, yes; Mr. Anderson, yes.

Case Z-588E approved with modifications.

CASE Z-568B – Versant Group, LLC (Maderas Creek)

Request is for a Planned Development Residential (PD-R) second stage and final plan approval to change previously approved site and elevation plans to allow for construction of 14 new condominiums for a total of 28 dwelling units on 6.842 acres of land located along the east side of Paragon Road between Alexandersville-Bellbrook Pike and I-675.

Greg DeLong , Senior Planner, presented the case.

Mr. Drain – How many units were previously approved?

Mr. DeLong – 18 units, which were never constructed.

Mr. Anderson – Indicated that the building elevations are different than what was in the original brochure. What elevations is the Commission being asked to approve?

Mr. DeLong – The building materials remained the same. The newer plans indicate alternative elevations so not all buildings will look the same.

Mr. Drain – Questioned the ability of their using unbuildable land in the density calculations. Also thought there should be connectivity with The Bluffs.

Mrs. Winwood – Thinks the connection to The Bluffs could create a cut through situation.

Applicant represented by Harold Williams, CEO, and John Webber, Versant Group, 75 Holiday Drive, Englewood, Ohio; Jim Bauman, Architect, and Kip Deaton, Project Manager, 55 Hillside Drive, Englewood, Ohio; and Kara Burkhardt, Engineer, 195 Byers Road, Miamisburg, Ohio.

Mrs. Winwood – Will any additional parking by provided?

Mr. Williams – The driveways are a minimum length of twenty feet (20’) to provide for driveway parking.

Mr. Anderson – Asked what materials would be used for the retaining wall?

Mr. Williams – Showed a slide of an existing wall that would be similar that is made from natural boulders.

Mr. Drain – Asked about the viability of relocation of the creek and building on areas that were once wet.

Ms. Burkhardt – The developer is aware of the engineering requirements of building in areas such as this. They will be required an individual permit from the Corps of Engineers and the Ohio EPA for the relocation of the creek.

Mr. Anderson – Asked how the reserve underground water detention storage would be constructed since the landscape plan shows plantings on top of them.

Ms. Burkhardt – The final determination will be determined through the engineering review through the County Engineers Office. Landscaping would be adjusted on top.

Mrs. Winwood – Asked if the creek is spring fed?

Ms. Burkhardt – Stated that the developer could best answer the question, but she believes most of the water in the creek is passed through water from the storm sewer system.

Mr. Drain – Can you make this project work with fewer units?

Mr. Williams – Yes, but they would not like to be reduced to 12 buildings.

Citizens voicing concerns, questions and comments included:

Mike Ahalt, 314 Trebor Lane – Concerned with the change in elevation from The Bluffs south drive and the proposed drive for this development. Mr. Ahalt would like additional buffer between The Bluffs and this development since they will be looking at rooftops.

Dan Fleshman, 300 Trebor Lane – The location of Building 8 is going to be able to look into their unit in The Bluffs. He has a concern with the loss of privacy.

Nancy Hendrickson, 7167 Bluffs Drive – Stated that the woods located between her property and I-675 is a buffer for her. She is not in favor of building in this wooded area.

Shirley Andres, 317 Grants Trail – Is concerned with the number of units proposed. She is a realtor and has concerns with them being able to get $325,000 for the units being that close to I-675.

Joe Harmon, 531 Willowhurst Drive – Concerned with the storm water and landscaping.

Mary Gillespie, 302 Trebor Lane – Would rather see 8-10 buildings instead of 14 buildings. She would also like to see more of a buffer along the north property line.

Jon Klein, 329 Grants Trail – Stated his concerns with the loss of trees and increase in noise from I-675. He is also concerned with the increase of traffic on Paragon Road.

Al Alesi, 396 Grants Trail – Is concerned with the density and relocation of the creek with the potential of increased velocity of the creek.

Commission remarks, concerns and comments included:

Mr. Drain – Thinks the units are very attractive but has a concern with the density. Mr. Drain would like to see 27.5 feet between buildings.

Mrs. Zobrist – Likes the architecture. She is concerned with the lack of additional parking for guests. She is also concerned with straightening out the creek and the property owners downstream having a problem with the increase in velocity.

Mr. Rogers – Likes the units proposed. He also has a concern with the lack of parking; however, he does not have a concern with the density since it is below our maximum.

Mrs. Winwood – Likes the buildings but feels they need to fit in with the surrounding area.

Mr. Anderson – Likes the plan as submitted. He shares the concerns with parking as well as concerns with the straightening of the creek.

MOTION - Mr. Drain moved in Case Z-568B to table applicant’s request for a Planned Development Residential (PD-R) second stage and final plan approval to change previously approved site and elevation plans to allow for construction of 14 new condominiums for a total of 28 dwelling units on 6.842 acres.

Motion seconded by Mrs. Winwood.
